End User License Agreement (EULA) for Marney Gallery

This End User License Agreement ("Agreement") is a legal contract between you (the "User" or "Licensee") and Marney Gallery ("Licensor", "we", "our", or "us") regarding the use of our website (marneygallery.com), digital content, and the artwork, photographs, and merchandise purchased through our platform or official partners.

By purchasing a physical product, downloading digital content, or accessing our gallery platforms, you agree to be bound by the terms of this Agreement. If you do not agree, do not complete your purchase or use the content.

1. Intellectual Property Ownership

All photographs, digital art, logos, text, and designs displayed on our website or featured on our product lines (including but not limited to prints, keyrings, magnets, and bookmarks) are the exclusive intellectual property of Lewis James Marney / Marney Gallery.

Your purchase of a physical product or viewing of an image grants you a limited usage license, not a transfer of ownership of the underlying copyright.

2. Scope of License (Permitted Uses)

When you purchase a piece of artwork or merchandise from Marney Gallery, you are granted a Personal, Non-Commercial, Non-Exclusive, Non-Transferable License to:

  • Display physical prints, framed or unframed, within private residences or commercial business spaces for decorative purposes.

  • Use purchased physical merchandise (keyrings, magnets, bookmarks) for personal use or as individual gifts.

  • Share images of your purchased, physical artwork on personal social media channels, provided that Marney Gallery is clearly credited.

3. Prohibited Uses (Restrictions)

You are strictly prohibited from the following activities unless you have obtained explicit, written prior consent from Marney Gallery:

  • No Commercial Exploitation: You may not use any artwork, digital assets, or images from Marney Gallery for commercial gain, advertising, or corporate branding.

  • No Replication or Modification: You may not scan, digitise, copy, reproduce, alter, or create derivative works from any physical or digital products purchased.

  • No Digital Resale or Redistribution: You may not upload high-resolution files of our artwork to third-party platforms, stock photography websites, or print-on-demand services.

  • No AI Training: You may not use any images or content from Marney Gallery to train machine learning algorithms, artificial intelligence tools, or generative art models.

4. Limited Edition Prints

For products designated as Limited Edition Prints:

  • The license is bound to that specific, numbered physical print accompanied by its official Certificate of Authenticity.

  • Resale of the original physical print on the secondary art market is permitted, provided the Certificate of Authenticity is transferred alongside the print and the new owner agrees to abide by the copyright restrictions outlined in this Agreement.

5. Termination

This license is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Marney Gallery if you fail to comply with any of its terms. Upon termination, you must cease all unauthorised use of the copyrighted materials.

6. Limitation of Liability

Marney Gallery provides its products and website content on an "as-is" basis. To the maximum extent permitted by UK law, Marney Gallery shall not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the products, even if advised of the possibility of such damages.

7. Governing Law

This Agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with this license shall be subject to the exclusive jurisdiction of the courts of England and Wales.
